01 FDA Regulation of Vaping Products

In the United States, electronic nicotine delivery systems (ENDS), including disposable vapes and e-liquids, are regulated by the U.S. Food and Drug Administration (FDA) under the Family Smoking Prevention and Tobacco Control Act. The FDA is the authority that oversees how these products are made, marketed, and sold.

02 Premarket Authorization (PMTA)

Manufacturers of vaping products are required to submit a Premarket Tobacco Product Application (PMTA) to the FDA. The FDA reviews these applications and decides which products may be legally marketed. This review process is ongoing, and the status of many products in this category continues to change.

VapesCastle sources products from suppliers and works to sell products that comply with applicable federal and state requirements. Responsibility for FDA marketing authorization rests with the product manufacturers, and we encourage customers to review current FDA guidance for the latest status of any product.

03 Minimum Age: 21 and Older (Tobacco 21)

Under federal law, it is illegal to sell tobacco and vaping products to anyone under 21 years of age. This is known as the Tobacco 21 law. VapesCastle strictly follows this rule.

You must be at least 21 years old to buy from VapesCastle. We use age verification at checkout, and orders may require adult signature confirmation at the time of delivery. We do not knowingly sell to minors, and we reserve the right to cancel any order that cannot be age verified.

04 PACT Act & Shipping Compliance

The Prevent All Cigarette Trafficking (PACT) Act sets rules for how vaping products can be shipped and sold across state lines. It includes requirements around age verification, record keeping, and shipping.

VapesCastle ships in line with applicable PACT Act requirements and only ships to adults where the sale and delivery of vaping products is legal. We do not ship to any location where these products are restricted or banned by law.

05 State & Local Laws

Vaping laws are not the same in every state or city. Some states have extra taxes, flavor restrictions, licensing rules, or shipping limits. VapesCastle follows the federal law and the state and local laws that apply to each order.

If a product or flavor is not allowed in your area, we will not ship it there. It is also the customer's responsibility to know and follow the vaping laws in their own state, county, and city before ordering.

06 No Health or Medical Claims

VapesCastle does not sell vaping products as a way to quit smoking, and we make no medical or therapeutic claims about any product. Our products are not intended to diagnose, treat, cure, or prevent any disease or health condition.

Nicotine is an addictive chemical. If you have questions about nicotine, smoking, or your health, please speak with a licensed doctor or healthcare provider.

07 Who Should Not Use These Products

Vaping products are for adult use only. They should not be used by anyone under 21, by non-smokers, by people who are pregnant or breastfeeding, or by people with heart conditions, high blood pressure, diabetes, or who are sensitive to nicotine or any ingredient in the product.

If you are unsure whether these products are right for you, do not use them until you have spoken with a healthcare professional.

08 California Proposition 65 Notice

For customers in California: these products can expose you to chemicals, including nicotine, which is known to the State of California to cause reproductive harm. For more information, visit the official Prop 65 site at p65warnings.ca.gov.

09 Authentic Products Only

VapesCastle works to sell only genuine products from real brands and authorized channels. We do not knowingly sell fake or counterfeit vapes. If you ever receive a product you believe is not authentic, contact our support team right away and we will look into it.
